Legal basis for the processing of personal data

Where I obtain the data subject’s consent for the processing of personal data, Article 6(1)(a) of the GDPR serves as the legal basis.

Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary for the implementation of pre-contractual measures.

Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) of the GDPR serves as the legal basis.

Where the processing of personal data is necessary to protect the vital interests of the data subject or of another natural person, Article 6(1)(d) of the GDPR serves as the legal basis.

Where processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Article 6(1)(f) of the GDPR serves as the legal basis for data processing.

Data erasure and retention period

The data subject’s personal data will be erased as soon as the purpose for which it was stored no longer applies. Data may also be stored if this is required by European or national laws or other regulations to which the controller is subject. Data will also be blocked or deleted when a storage period prescribed by the aforementioned regulations expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.

Log data

The internet service provider (ISP) automatically collects and stores log data because the processing of this data is technically necessary to display our website to you and to ensure its stability and security. The log data includes the following information:

This data is transmitted to me automatically and cannot be attributed to you personally without a disproportionate amount of effort. The legal basis for the processing of this data is our legitimate interest pursuant to Article 6(1)(f) of the GDPR, as this data processing is necessary for the operation and display of the website. The data is deleted as soon as it is no longer required to fulfil the purpose for which it was collected. In the case of data collected for the provision of the website, this is the case once the respective session has ended. The collection of data for the provision of the website and the storage of data in log files is strictly necessary for the operation of the website. Consequently, the user has no right to object.

Newsletter

The information provided in this section explains how the registration, distribution, analysis and content of our email newsletter are organised.

If you wish to subscribe to my email newsletter and read it regularly, you must register using a valid email address, thereby giving your consent to the processing of your personal data by me. Please note the declaration of consent on the newsletter registration form.

Before the newsletter is sent, you must expressly confirm to me, as part of the so-called double opt-in procedure, that I should activate the email newsletter service for you. I do this to prevent third-party email addresses from being used for registrations. To this end, you will receive a confirmation and authorisation email from me, in which I ask you to click on the link contained in this email and thereby confirm that you wish to receive my newsletter. If you do not confirm, your personal data will be deleted within 7 days.

In connection with the registration, in addition to the email address, the time of registration, the time of confirmation, the IP address and the consent text are also stored, and I use the email address exclusively for the delivery of the newsletter unless you have expressly consented to any other use.

Get in touch

When you contact me (e.g. via the contact form, email, telephone or social media), your details will be processed for the purpose of handling your enquiry and its follow-up in accordance with Article 6(1)(b) of the GDPR. Your details may be stored in a customer relationship management system (“CRM system”) or a similar enquiry management system.

I will delete the enquiries once they are no longer required. I review their necessity every two years; furthermore, the statutory archiving requirements apply.

Facebook Pixel, Custom Audiences and Facebook Conversion

Within my online service, the so-called “Facebook Pixel” of the social network Facebook, operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”), is used.

Facebook is certified under the Privacy Shield Framework and thereby guarantees compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

With the help of the Facebook Pixel, Facebook is able to identify visitors to our website as a target audience for the display of advertisements (so-called “Facebook Ads”). Accordingly, I use the Facebook Pixel to ensure that the Facebook Ads I place are shown only to those Facebook users who have demonstrated an interest in my online offering or who exhibit certain characteristics (e.g. interests in specific topics or products, determined on the basis of the websites visited), which I transmit to Facebook (so-called “Custom Audiences”). I also use the Facebook Pixel to ensure that my Facebook Ads match users’ potential interests and do not come across as intrusive. Furthermore, with the help of the Facebook Pixel, I can track the effectiveness of Facebook adverts for statistical and market research purposes by seeing whether users were redirected to my website after clicking on a Facebook advert (so-called “conversion”).

I also use the “Custom Audiences from File” feature provided by the social network Facebook, Inc. In this case, the email addresses of newsletter subscribers are uploaded to Facebook. The upload process is encrypted. The sole purpose of the upload is to identify recipients of my Facebook adverts. I wish to ensure that the adverts are only shown to users who have an interest in my information and services.

You can object to the collection of data via the Facebook Pixel and the use of your data for the display of Facebook ads.
